What legal argument do experts use to differentiate Pike's case from 1947?
Why do experts argue a second execution attempt would be unconstitutional?
Full Summary
With the astonishing news that Christa Pike is conscious, talking and making a "medically unprecedented" recovery following her botched execution, Tennessee is now facing a critical question: Will the state try to kill her again?

Christa Pike is conscious and speaking in the hospital after surviving Tennessee's attempt to execute her last week, her lawyers said Tuesday.
"Against all odds, Christa Pike is conscious, speaking, and continues to receive critical medical care. Despite the severe damage she endured to her arms, she is still handcuffed and shackled to the bed. Her recovery is medically unprecedented. Her prognosis remains unclear but, at a minimum, we expect a long recovery," her legal team wrote in a statement released to the media.
Pike had been unconscious and in critical condition in the days after two doses of pentobarbital failed to end her life on Wednesday, Sept. 30, according to her attorneys.
Dr. Joel Zivot, a medical expert who has consulted with Pike's legal team, told the **** ociated Press that the latest update "bodes well for a good recovery," but said that the full picture of her long-term health won't be clear for some time.
"She has recovered to a certain degree that she's able to be off a ventilator and able to speak, but in no way would I announce her free of further serious risk," he said. "There's still a lot of bad things that can happen here."

ATLANTA (AP) — Georgia Tech coach Brent Key said Jaylen Mbakwe was talking and responsive after a scary collision that had him stretchered off the field in the third quarter of the Yellow Jackets' 45-24 loss to No. 18 Tennessee on Saturday night.
Mbakwe collided head-first with Jordan Walker's knee. Walker was carried off the field, unable to put any weight on his leg. Mbakwe lay on the field and appeared motionless for several minutes before giving the crowd a thumbs-up while being stretchered off.
"Everything was moving when they moved him off the field. He was talking, responsive," Key said after the game. 'Obviously, I'm not going to speak anything medically about it, because I don't know."
The defensive back was taken by ambulance to Grady Hospital, located three miles from Georgia Tech's Bobby Dodd Stadium.
"As soon as I walk out of here, that's where I'm going — to check on my guy," Key said. "But he was talking, he was moving and whatnot when they carried him off. That's all I know at this point."

A surrogate who defied a California couple's demand to abort their baby after a devastating heart diagnosis is taking her fight to the U.S. Supreme Court, arguing a lower court ruling has left her powerless to advocate for the medically fragile newborn.
Attorneys for Alaska cardiac nurse McKenna West filed an emergency application Wednesday, asking Justice Elena Kagan to temporarily block a Los Angeles court ruling that declared the California couple the baby's legal parents.
Kagan handles emergency matters arising from the 9th Circuit, which includes California. She has not ruled on the request.

The family of a South East High School football player who died after suffering a brain injury during a game has filed a wrongful death lawsuit against the Los Angeles Unified School District, alleging the district failed to provide safe conditions.
Christopher Garcia, a 16-year-old junior varsity football player, suffered the injury in 2024 after making a defensive tackle during a game. Attorneys for the family on Tuesday released footage of the play.
The video shows Garcia tackling a receiver before his head struck the field. He was later placed into a medically induced coma and died 11 days later.
According to the lawsuit, Garcia's family alleges the district failed to provide "safe facilities, proper equipment, and adequate supervision," which they contend led to their son's death.
Garcia's sister, Kimberly Garcia, spoke on behalf of the family regarding the lawsuit they have filed.

Abishek Porel, the Delhi Capitals and Bengal cricketer, has been denied bail in an alleged rape case involving a medical student. A court on Friday sent him to judicial custody for 14 days.

Porel was arrested on August 11 in Hooghly after being questioned over a complaint filed by a young woman, who accused him of rape, blackmail and other offences. He was later medically examined before being produced before the Chinsurah court.

"There was a case lodged against him and a court order to arrest him. He was arrested late last night. He will be produced in court today," Hooghly (Rural) Superintendent of Police Kunar Bhushan Singh told PTI.
According to the complaint, the woman said Porel entered into a relationship with her after promising to marry her. She alleged that after their relationship ended, he threatened to share private photographs of her. Police registered a case under 19 sections, with most of the charges being non-bailable.

The complaint also refers to an alleged incident in Delhi on April 2, 2026. The woman claimed she was confined, not given food and deliberately kept isolated, leaving her physically weak and unable to walk properly.

She further alleged that both families had discussed marriage, but the relationship later deteriorated after she allegedly found out about Porel's involvement with other women.
The case had previously reached the Calcutta High Court. Justice Saugata Bhattacharyya directed Magra Police Station to seize electronic devices, including Porel's mobile phone, and submit an investigation report.

At the August 11 hearing, police told the court that Porel had been arrested and would be produced before the Chinsurah court. The cricketer has now been denied bail and remanded to judicial custody for 14 days while the case proceeds.

As a reminder, today's game is on AppleTV.
Yesterday afternoon was disappointing, but taking three of four from the Red Sox still counts as a statement by a team that's playing surprisingly well since the deadline.
The Yankees will test whether this run can amount to anything. The Jays draw Gerrit Cole today, Cam Schlittler tomorrow, and Ryan Weathers on Sunday. That's about as tough of a pitching series matchup as it gets. But hey, we have Paul Sewald now, so there.
We got little bits of news today. Anthony Santander is apparently hitting off a tee. That's good for him, but I'm operating under the ******* umption that he's effectively medically retired until we get proof otherwise.
As mentioned, Paul Sewald is active tonight. He's posted a really good K:BB ratio this year (44:9 in 39 innings), but 12 home runs have blown up his ERA. Hopefully either luck or a new coaching staff gets him past that issue. Lazaro Estrada goes down for the corresponding move. Due to a new rule this year, because he's been optioned five times now this season he'd have to be DFA'd if he's brought back and sent down again. It's not a big thing, as he hasn't been good this year, but it just adds one more wrinkle to an already complicated Jays pitching situation.

Samuel Monroe Jr. remains on life support in a Los Angeles hospital as his family waits for additional brain scans before making what they have described as an extremely difficult decision about his care.
The 52-year-old actor remains in a medically induced coma after months of serious health complications involving meningitis, MRSA pneumonia and other conditions.
His wife, Shawna Stewart, told TMZ in an August 8th update that Monroe's brain continues to swell and that doctors have warned his family about the possibility that he may not regain meaningful consciousness.
For now, no decision has been announced. Stewart said the family has agreed to wait for several more CT scans before determining how to proceed.
Stewart told TMZ that Monroe's ventricles have become enlarged as his brain continues to swell, contributing to seizures. She said he has undergone three brain surgeries while doctors continue monitoring his condition with CT scans. Monroe is also dealing with serious complications beyond his brain. Stewart said his left lung has partially collapsed.

Few, if any, movie stars achieve the level of celebrity of Paul Newman without good fortune. No one recognized that more than the screen legend himself.

Newman's luck did not begin with his three-year stint in the U.S. Navy during World War II. He understood during his years in the Pacific (and then in Hollywood) that fate fell in his favor more than once.

While serving his country, forces beyond his control likely saved Newman's life. If a pilot in his squadron hadn't come down with an ear issue, Newman might have died at Okinawa—one of the bloodiest battles in military history. Then Newman was supposed to take part in the invasion of mainland ***** an. Dubbed Operation Downfall, Allied commanders called it off after the bombings of Hiroshima and Nagasaki.

Newman, who died on September 26, 2008, at the age of 83, admittedly didn't fully consider the potential consequences when he enlisted.

"I thought it would be a big adventure," Newman said of joining the military during wartime. "I was really dumb. I never considered that it might be dangerous."
Academy Award-winning actor Paul Newman served in the Navy for 3 years. (U.S. Navy illustration/Peggy Frierson)
Born on January 26, 1925, in Ohio, Newman was in his first year at Ohio University when he dropped out. Newman signed up for the Navy with the intent of becoming a pilot. He never made it to the ***** pit after a supposedly routine exam revealed he was colorblind.

Newman pivoted from that diagnosis and began training as a rear gunner and radioman for Grumman TBF Avenger torpedo bombers. In the Pacific, the Navy ***** igned Newman to squadrons that trained air crews and pilots. After a stint as a turret gunner, the plan was for Newman and his squadron to meet up with the USS Bunker Hill, an aircraft carrier stationed near the shore of Okinawa.

They never made it that far after their pilot wasn't medically cleared to fly. That turned out to be a likely life-saver after the ***** anese unleashed kamikaze attacks on the USS Bunker Hill on May 11, 1945. Nearly 400 men on the carrier died, with 264 more wounded.

It wasn't the only time that Newman, then only 20 years old, skirted death during the war. He did it again a few months later. When the United States dropped an atomic bomb on Hiroshima on August 6, 1945, Newman was on an aircraft carrier several hundred miles from ***** an. Three days later, another bomb destroyed Nagasaki.

Approximately 214,000 ***** anese citizens, including roughly 38,000 children, died in the attacks, per the International Campaign to Abolish Nuclear Weapons (ICAN). Those numbers don't include those who were maimed. While President Harry S. Truman's decision remains a source of debate, but Newman didn't question it.

"I know all of the controversy about those weapons," Newman said. "But I'm one of those guys who says, 'Thank God for the atomic bomb,' because it pro

Lerryan Douglas isn't ranked yet – but it sounds like he's close.
His second UFC fight will take place Aug. 22, but Douglas (14-5 MMA, 1-0 UFC) is already being viewed by the promotion as a worthy opponent for top-tier talent. After a scintillating sub-four-minute knockout debut vs. Julian Erosa in March, Douglas recently told MMA Junkie Radio he was offered two ranked opponents.
"I don't think I'm supposed to be saying stuff like that, but I already got offered two ranked fighters and they didn't work out because they weren't clear medically," Douglas said. "I said yes to both of them, and one of them was short notice. That's what I'm saying. I'm always ready. Whenever the UFC wants to give me an opportunity, I'll be ready to go. ... I know they're happy with me."
How can Sean Shelby not be happy? Douglas has brought the violence consistently, as he ended his six most recent bouts with strikes. He has the chance to make it seven-for-seven when he faces Jamall Emmers at UFC Fight Night 285 at Golden 1 Center in Sacramento, Calif.
Emmers (22-8 MMA, 5-4 UFC) is a seasoned veteran with 14 years of professional experience under his belt. At 37, Emmers hasn't shown signs of slowing down, though, coming off back-to-back victories over Gabriel Miranda and Hyder Amil.

NFL teams and NFL players are not famously open and transparent about injury timelines, but Michael Penix Jr. was an exception today.
Per the team's 2025 starting quarterback, his recovery from his November ACL injury is progressing nicely, but it still could be a month until he's fully medically cleared. If all goes well, Penix noted, it could be a little sooner. Because the long end of that estimate would put us at August 29, that likely means the most hotly-anticipated battle of camp is all but over. So long as Tua Tagovailoa's back tightness is indeed minor, he'll be starting in Week 1.
When Penix suffered his ACL injury and had surgery, insider Ian Rapoport initially reported that it would carry a nine month recovery at minimum. Since then, both the team and Penix have avoided putting concrete timelines on his recovery, but mid-August would be around nine months and Penix now seems unlikely to be cleared by then.
Fans inserted their own timelines into the vacuum between Rapoport's initial report and the months that have come. Some very optimistic souls believed he could be cleared for minicamp, but that time came and went. Others hoped we might see Penix cleared in time for the start of training camp, a more reasonable guess but still a bit of an optimistic one.
On the first day of training camp, Penix was out there moving and throwing, but he still has not been fully medically cleared and cleared for full team work. The long and short of it is that Penix can do some work and give the coaching staff a measure of his ability, but cannot fully participate in training camp and almost certainly will not appear in preseason action. He'll get to build rapport with receivers because he's there and throwing—and he chucked a long touchdown to Zachariah Branch Wednesday—but obviously the work of running the offense and participating in scrimmages and the like is still a ways away.

SAO PAULO (AP) — Inter Porto Alegre defender Víctor Gabriel has been suspended from Brazilian soccer until Cruzeiro forward Gabriel Pec returns to training following recovery from a broken leg.
The sanction was handed down Tuesday by Brazil's Superior Court of Sports Justice, the country's highest independent body for sports discipline.
The court deemed a standard penalty insufficient given the severity of the incident. Pec suffered a left tibia fracture in a challenge from Víctor Gabriel in a league game on July 22.
While the court's suspension is capped at 180 days, it could end sooner if Pec is medically cleared to return to practice ahead of that time. The decision can be appealed.
Víctor Gabriel told the court he had no intention of causing injury to Pec, who played for LA Galaxy in the MLS before joining Cruzeiro for a club-record fee of at least $12 million during the World Cup break.

WASHINGTON – Six weeks after he was hospitalized for a fall and pneumonia, Sen. Mitch McConnell's doctors still have not medically cleared him to return to work or leave a rehabilitation facility, the Capitol physician's office said.
Since June, the Kentucky Republican's health has been a source of widespread speculation and interest. He has missed 38 roll call votes in the Senate, including on key measures such as the annual defense policy bill and ending the Iran war, as well as high-profile confirmation hearings for crucial Trump nominees like Todd Blanche, who is awaiting a vote to become the next attorney general.
All summer his office has provided only limited updates on his condition. But in a statement July 27, McConnell, 84, said he was still having "intense physical therapy" and wouldn't be able to travel to western Kentucky for the annual Fancy Farm picnic, a marquee political event in the state.
"As always, I appreciate all of your continued well wishes, and I'm looking forward to getting back to the Senate and to Kentucky soon," he said.
The Office of the Attending Physician, which provides medical services and guidance to members of Congress, said the lifelong effects of McConnell's bout with childhood polio continue to be a "significant factor in his mobility." Doctors visit with him every day.

A former Husker announced his retirement from the NFL on Wednesday night. Tight end Travis Vokolek made the announcement on Instagram that he is medically retiring.
Vokolek suffered a neck injury last season while playing for the Arizona Cardinals. He was the third-string tight end for the Cardinals and played a part on special teams. Vokolek spent two seasons with Arizona after initially going undrafted as a free agent to the Baltimore Ravens. He played in five games for the Cardinals and totaled two solo tackles.
"After numerous visits with doctors and neurologists over the past couple of months, I have been advised to medically retire from the NFL due to a serious neck injury that I suffered this past season," he wrote in his post. "I am extremely grateful and blessed to have been able to live out my childhood dream of playing football at the highest level for the past three years. Football has taught me many life lessons and given me unforgettable memories."
Vokolek played three seasons at Nebraska after transferring from Rutgers in 2019. In his final season for the Huskers, he played in 10 games and set career highs with 20 catches, 240 receiving yards and two touchdowns. During this year's free agency cycle and 2026 NFL draft, all four AFC North teams made significant moves to add talent to their rosters. While more additions are still possible over the next few months, everyone's core players are mostly set ahead of the 2026 season.
How do the different positional groups in the division stack up to one another? Let's rank the AFC North squads by position, continuing with cornerback.
Starters: Joey Porter Jr., Jamal Dean, Jalen Ramsey
Depth: Asante Samuel Jr., Daylen Everette, Brandin Echols
The Steelers are returning Joey Porter Jr. and Jalen Ramsey as primary cornerbacks while making two notable additions this offseason. Veteran Jamal Dean was inked to a three-year contract after playing seven years in Tampa Bay, where he established himself as a reliable and consistent player. Although he's never earned Pro Bowl or All-Pro recognition, Dean was PFF's No. 3 graded cornerback in 2026 with three interceptions and two passes defended. Porter has become a high-level coverage player through three seasons and has the potential to make a jump to stardom status in Year 4. A potential X-factor is Asante Samuel Jr., who the Steelers also signed after he was medically cleared to return from a spinal injury,

WASHINGTON (AP) — Defense Secretary Pete Hegseth's new initiative to test and treat troops for low testosterone has prompted a federal judge to question the differences between that kind of testosterone replacement therapy and hormone treatment for transgender men in the military.
U.S. District Judge Ana Reyes in Washington raised the question Wednesday in an ongoing lawsuit against President Donald Trump's ban on transgender troops. Reyes noted that Trump's ban says "the Armed Forces must adhere to high mental and physical health standards ... without the benefit of routine medical treatment or special provisions."
Reyes ordered both parties in the lawsuit to address "the similarities and differences in administering TRT, both medically and logistically, for trans men compared to other service members, including cis individuals." She was using the acronym for testosterone replacement therapy.
The judge also requested information on the Pentagon's "basis for treating trans men and other service members differently between this new policy and the Military Ban."
Reyes' order comes a week after Hegseth announced that he is rolling out a new screening program for "testosterone deficiency" among troops, calling it necessary to allow them to operate at their "absolute best."

The U.S. military unleashed airstrikes against Iran on Saturday evening in retaliation for Tehran hitting two military bases in Jordan a day prior, during which two U.S. service members were killed, the U.S. Central Command announced (Centcom).
The new wave of strikes began at 6 p.m. EDT in what U.S. officials said was an effort to further degrade Iran's ability to threaten commercial shipping in the Strait of Hormuz and "punish" the Islamic Revolutionary Guard Corps forces who launched missiles and drones against U.S. soldiers in Jordan on Friday.
Apart from the U.S. service members who were killed in action in Jordan, one service member is currently missing, according to Centcom. The U.S. military death toll has now risen to 16 since the start of the conflict.
Four U.S. service members were medically evacuated to Jordanian hospitals and they have been discharged since. Other personnel who sustained "minor injuries" have returned to duty, according to the U.S. military.
"Godspeed, heroes. Their sacrifice only stiffens our resolve," Defense Secretary Pete Hegseth said on Saturday.

WASHINGTON (AP) — The Justice Department has charged a Texas doctor in an $89 million healthcare fraud scheme, accusing him of billing insurers for medically unnecessary cardiovascular screening tests for college student-athletes and then rubber-stamping the results as normal without reviewing them.
Jason Finkelstein, 53, faces charges of healthcare fraud and conspiracy in what prosecutors describe as a yearslong scheme that preyed on the fears of athletes that they could die on playing fields or courts of sudden cardiac arrest.
Athletes with no preexisting conditions who were concerned about being cleared to compete were administered tests they did not need and, in one case, a patient whose results were falsely certified as normal later died after his significant heart problems were undetected, the indictment says.
The prosecution is among a series of cases that the Justice Department intends to highlight at a news conference Tuesday in announcing what it says are record results in a nationwide crackdown on healthcare fraud, a long-running federal law enforcement priority that the Trump administration over the last year has sought to emphasize.
The department says Finkelstein's case, with allegations not only of unrendered services but also poor medical performance that put patients at risk, represents the type of sophisticated scheme prosecutors are striving to disrupt.
