An Arizona road rage killer will be resentenced after an appeals court ruled that an AI-generated video message from his dead victim was improperly aired in court.
Gabriel Paul Horcasitas was found guilty by a jury of shooting and killing Christopher Pelkey, 37, during a confrontation at a red light in 2021. He was sentenced to 10 years behind bars.
But his legal team appealed, arguing that the trial judge should not have allowed an AI video, created by Pelkey's family, to be shown in court ahead of last year's sentencing.
The Arizona Court of Appeals agreed, ruling that Horcasitas, 55, must be resentenced because the AI clip "crossed that line".
"Rather than document an event or recording a particular moment, the AI video presents a depiction of the victim and his thoughts created from the imaginings of the victim's sister," the court of appeals wrote on Wednesday.

The reports followed data this month showing producer and consumer prices accelerated in August, while the labor market regained its poise after wobbling through much of summer.
The Federal Reserve on Wednesday raised its benchmark overnight interest rate by a quarter of a percentage point to the 3.75%-4.00% range and flagged further increases in borrowing costs in the months ahead.

The biggest story of the opening week of the college football season was Michigan's controversial win over Western Michigan, as the Wolverines were given one last play after they appeared to lose the game on a failed Hail Mary. The decision led to a lot of criticism, but Barstool Sports founder Dave Portnoy does not agree with the critics.
Despite the outrage at the way the game ended, Portnoy claims that Michigan won the game "fair and square."

VanDyke was dissenting from the 9th Circuit's decision not to revisit Olympus v. Armstrong, a case that saw an all-female Korean spa sue on First Amendment grounds. The business, according to the Washington State Human Rights Commission (WSHRC), had broken the law when it declined to accept a preoperative transgender woman. This was a problem for Olympus Spa, which requires nudity in its pool area, and whose business model, relatedly, hinges on catering to a single-sex clientele.
In ruling against the business last year, the 9th Circuit acknowledged the thorniness of the case. "We are not unmindful of the concerns and beliefs raised by the Spa," wrote Judge M. Margaret McKeown. "Indeed, the Spa may have other avenues to challenge the enforcement action. But whatever recourse it may have, that relief cannot come from the First Amendment."
Olympus Spa is now taking its case to the Supreme Court. McKeown and VanDyke, whose vulgar approach elicited a rebuke from 27 of his colleagues, may appear irreconcilably at odds. De Nederlandsche Bank, DNB to its friends, closed 2025 sitting on 612.4 tonnes of gold worth €72.2 billion ($83.7 billion). About 31.3% of it lived in New York and another 19.7% in Ottawa, roughly 313 tonnes parked in North America. The 86 tonnes that left is a bit more than a quarter of that pile.
Roughly 59 tonnes never went anywhere at all. DNB sold that gold in New York and bought the same quantity in London, which is the bullion version of Venmo-ing a friend instead of driving across state lines with a duffel bag. The other 27-odd tonnes actually traveled, first from New York and Ottawa to DNB's own vault in the Dutch town of Zeist, then an equivalent amount from Zeist onward to London. De Nederlandsche Bank, DNB to its friends, closed 2025 sitting on 612.4 tonnes of gold worth €72.2 billion ($83.7 billion). About 31.3% of it lived in New York and another 19.7% in Ottawa, roughly 313 tonnes parked in North America. The 86 tonnes that left is a bit more than a quarter of that pile.
Roughly 59 tonnes never went anywhere at all. DNB sold that gold in New York and bought the same quantity in London, which is the bullion version of Venmo-ing a friend instead of driving across state lines with a duffel bag. The other 27-odd tonnes actually traveled, first from New York and Ottawa to DNB's own vault in the Dutch town of Zeist, then an equivalent amount from Zeist onward to London. The gold, in other words, flew with a layover. Structuring it that way let the bank skip melting down and re-casting bars to meet London's standards, which costs real money and carries the always-unwelcome risk of finishing the process with less gold than it started with.
