On August 13, a federal appeals court ruled in favor of Gilead Sciences, Inc. (NASDAQ:GILD), upholding a preliminary injunction that bars the defendants from importing or facilitating the sale of foreign-market Gilead-branded medications in the US. The US Court of Appeals for the Fourth Circuit found that the differences between Gilead's HIV medication for the US market and the foreign versions being imported were "material, not theoretical." The controversy began in December 2024 when Gilead Sciences, Inc. (NASDAQ:GILD) filed suit against a number of companies, including third-party administrator Meritain Health, pharmacy benefit manager ProAct, and pharmacies Rx Valet and Advanced Pharmacy, alleging illegal imports of its best-selling HIV drug Biktarvy.
The dispute dates back to December 2024, when Gilead Sciences, Inc. (NASDAQ:GILD) sued a group of companies, including third-party administrator Meritain Health, pharmacy benefit manager ProAct, and pharmacies Rx Valet and Advanced Pharmacy, alleging illegal imports of its top-selling HIV drug Biktarvy. The lawsuit arose from a specific instance in which a patient in Maryland received the medicine in the mail from Turkey, with label instructions written in Turkish.
A federal district court in Baltimore ruled in Gilead's favor and ordered a preliminary injunction, determining that the company was likely to succeed on its Lanham Act trademark violation and unfair competition arguments. As the case continued, the injunction was increased to include new sellers like CanaRx, ElectRx, and ScriptSourcing. The defendants filed an appeal with the Fourth Circuit, and the district judge declined to suspend the injunction while the appeal was pending, thus the import restriction has been in effect the entire time. The recent ruling maintains the order rather than overturning it.
In court documents, Rx Valet stated that the Turkish-sourced Biktarvy was chemically identical to the US version, which was offered at a significantly higher price. Meritain, for its part, said that it has never supported getting non-FDA-approved pharmaceuticals from outside the US and denies the claims, despite being named as a defendant.
The Fourth Circuit rejected the defendants' main argument that the imported and domestic versions of Biktarvy are interchangeable. The court's judgment that the two versions differ materially, not just in packaging or labeling, but also in the quality-control protocols that each version goes through before reaching a patient, challenges the basic argument that these alternative funding programs have used to support their business model.

After a slow start to the season, there would have been hope that this fixture against Nottingham Forest would be the moment things started to click for Tottenham Hotspur. Instead, Spurs had to settle for a goalless draw as their wait for a first Premier League goal of the season continued.
Roberto De Zerbi made three changes from the loss against Newcastle United, with Destiny Udogie and Savio getting their first league starts of the season, and Conor Gallagher returning to the XI in favor of Mateus Fernandes. This first half was full of physicality but not much quality. Both sides struggled to create clearcut scoring opportunities, with set pieces and long-range efforts the only real threats from either side. There was a sort of symmetry to the chance creation, though, as both Spurs and Forest saw attackers in behind one-on-one with the keeper only for the attacker to fail to capitalize and the referee to also call the play back. Omar Marmoush for Spurs was the first, breaking away from Neco Williams to latch onto Porro's long ball, only for a foul to be awarded to Williams for a shove by the Egyptian; while Morgan Gibbs-White was flagged for offside as he sprinted in behind Jan Paul van Hecke.
With both sides failing to score in the first half, it looked like Forest may have opened the scoring in the second. Really poor positioning from Jan Paul van Hecke allowed Gibbs-White to get in behind; Kinsky did enough to at least deflect Gibbs-White's shot, but Sandro Tonali whiffed on a clearance before Williams appeared to bundle the ball into the net by way of a diving header. It was a calamitous concession by Spurs, but one that did not stand for long, as replays showed the ball ended up in the net off Williams' arms with VAR overturning the goal.
A flurry of substitutions followed from both sides as both managers searched for a winner. Neither side was able to muster the quality to create anything to break the deadlock, however, and a late headed chance from substitute Dominic Solanke that went well over the crossbar was the final chance of a reasonably low-quality affair with the match finishing 0-0.

Justin Baldoni's attorney, Bryan Freedman, is declaring a legal victory after a judge awarded Blake Lively only a fraction of the nearly $8 million she requested in attorneys' fees and costs. While Freedman expressed support for the California law used to grant Lively the award, he argued that it was applied in a way lawmakers never intended. The law allows a prevailing defendant in certain defamation cases involving reports of ****** ual ****** ault, harassment or discrimination to recover reasonable attorneys' fees and costs. Although Freedman said he fundamentally supports the law's intended purpose, he questioned how it was used in the dispute involving Lively and Baldoni.
"Notwithstanding the fact that the law was applied in ways it was never intended for, my clients intentionally left Section 47.1 to be ruled on without any appellate rights to appeal as part of the settlement agreement, to prevent either party from overturning the law," Freedman said.

Former IPL chairman Lalit Modi, the BCCI and some of its office-bearers received major relief after the Appellate Tribunal under SAFEMA set aside a key Enforcement Directorate (ED) penalty in a Foreign Exchange Management Act (FEMA) case linked to the 2009 Indian Premier League in South Africa.

The case stemmed from the IPL’s relocation to South Africa due to India’s general elections in 2009. The ED had alleged that overseas remittances of around 243 crore ($49.86 million) made to Cricket South Africa for hosting the tournament violated FEMA provisions.

However, a division bench comprising chairman Justice Munishwar Nath Bhandari and member Rajesh Malhotra ruled that the payments were legitimate operational expenses and qualified as current account transactions, which did not require prior approval from the Reserve Bank of India. The judgment was delivered on July 16.

In its order, the tribunal described Modi as the “chief architect” behind the organisation of IPL-2 in South Africa and held that there was no material to show he was responsible for BCCI’s statutory FEMA compliance. It termed the penalty imposed on him “wholly erroneous” and set it aside.

Welcoming the verdict, Modi said: “The Tribunal has rejected the central premise on which the Enforcement Directorate’s case against me had been built. It held that the principal foreign remittances relating to IPL 2009 in South Africa were current account transactions, not capital account transactions.”

Calling the ruling a vindication after a prolonged legal battle, Modi added: “For over 16 years I have consistently maintained that I acted in good faith, in the best interests of Indian cricket and the IPL, and committed no personal wrongdoing.”

The tribunal also granted relief to the BCCI and State Bank of India, overturning most of the ED’s 2018 penalty order while retaining only minor fines on the BCCI for administrative delays.

Former Fifa president Sepp Blatter has urged the world of football to kick Gianni Infantino out of the role, claiming the recent World Cup "lost its credibility" due to the actions of his successor.
Blatter – whose own Fifa presidency was rife with accusations of corruption – insisted that "politics must not be allowed to overshadow the game", seemingly in reference to Infantino's close relationship with US president Donald Trump, which helped lead to the controversial overturning of USA striker Folarin Balogun's ban for the red card he received against Bosnia.
Trump intervened, getting on the phone to Infantino urging him to look at Balogun's sending off and, in due course, Fifa unprecedentedly suspended the ban for a year, enabling the forward to play in the last-16 clash with Belgium, where the US were hammered 4-1.
And reflecting on the World Cup, which ended on Sunday evening with Spain beating Argentina 1-0 after extra time in an ill-tempered final, Blatter was unimpressed.
"The longest World Cup has come to an end – with the right champions," he wrote on social media. "But on the way to the final whistle, the tournament had lost its credibility.

President Trump’s intervention to lift the red card ban on U.S. Men’s National Team soccer player Folarin Balogun is breaking the integrity of the World Cup tournament.
Now, the French national team has appealed to FIFA, the soccer governing body, to rescind Michael Olise’s yellow card, which he received during the match with Paraguay on Saturday. Olise was penalized for a tackle for contact with Paraguyan Matias Galarza’s face, but replays showed Olise only held Galarza’s shirt.
A yellow card doesn’t directly translate into a suspension like a red card, but France evidently feels that overturning Balogun’s suspension has opened the door. It follows British Prime Minister Keir Starmer also intervening with FIFA to prevent moving up the start time for England’s match against Mexico over weather concerns, with England believing that they wouldn’t have enough time to train for high-altitude conditions at Mexico’s national stadium, Estadio Azeteca.
FIFA, meanwhile, denied an appeal from Belgium Monday challenging the decision to lift Balogun’s red card.

BOSTON — In addition to the usual batting practice and fielding drills, the Red Sox spent some additional pre-game time Tuesday on refining their ABS challenges.
With interim manager Chad Tracy serving as a makeshift umpire behind the plate, the Red Sox rotated all three of their catchers and another three or so hitters at the plate, in an effort to refine their approach to ball-and-strike challenges.
According to Baseball Savant, Sox hitters have been among the least successful teams on a percentage basis, getting just 38 percent of their calls right when it comes to overturning challenges, with only Cleveland and Atlanta ranked below them.
On the defensive side, the Red Sox haven’t been much better, ranked 24th among all MLB teams with a success rate — mostly initiated by catchers — at just 51 percent.
“We just haven’t been as good at it as we need to be,” said Tracy. “We put some steps into place before we left on the road trip and saw some good results in the couple games in Cleveland, especially the last day. But broadly, sometimes we don’t challenge enough and maybe we hold too many, just waiting for big moments, when there’s a lot of egregious calls prior to that we know...it’s not a strike.
